SUMMARY:Florida’s Vaccines for Children Program: The Basics\, Billing Prohibitions\, and Overpayment Issues
DESCRIPTION:In the early nineties\, the federal Vaccines for Children (VFC) program was created largely in response to the spread of measles among children. The program provides the CDC funding to create and distribute vaccines to states at no cost\, specifically for children. Each state\, including Florida\, participates in the VFC program and has enacted their own rules and regulations governing the operation of the VFC program within their states. This presentation will focus on the Florida VFC program\, discussing the foundation of the program\, an overview of the basic provisions and rules regulating the program\, payment and reimbursement prohibitions for vaccines\, and an in-depth discussion of litigation than can arise when insurers mistakenly pay claims for vaccinations improperly billed by providers under the Florida VFC program.

SUMMARY:9418 - Trinity Cocktail Prescriptions: How Florida Pharmacies Can Navigate the DEA’s National Crackdown
DESCRIPTION:This presentation will discuss the DEA’s efforts to crack down on “Trinity cocktail prescriptions.” Trinity cocktail prescriptions involve the prescription of three particular types of medication (an opioid\, a benzodiazepine\, and a muscle relaxer) that\, when combined\, are dangerous and potentially lethal to patients. In response to the opioid crisis\, the DEA has been cracking down on pharmacies\, pharmacists\, and prescribers by revoking providers’ controlled substance registrations (effectively shutting them down). Several such investigations have been initiated against Florida-based providers. \nThe presentation will review published opinions arising from these DEA actions\, with a particular focus on Florida actions\, discuss the legal process and standards applicable to such actions\, and provide best practices to avoid or manage revocation actions related to Trinity prescribing. Although Trinity cocktail prescriptions are a national problem\, this presentation will focus heavily on the State of Florida\, including an emphasis on Florida DEA actions and a discussion of the Florida standard of care applicable to prescribers.

SUMMARY:8600 - Arbitration’s Evolving Impact on Florida Litigation
DESCRIPTION:Over the past 20 years\, the landscape of Arbitration has changed significantly. Nationally\, the United States Supreme Court has issued multiple opinions about the enforceability of arbitration clauses and class action waivers. Locally\, Florida enacted in 2013 the biggest change to its arbitration laws in more than half a century. Lawyers who must analyze and consider contractual provisions relating to arbitration or the waiver of a right to bring a class action\, often found within the same provision\, must understand the impact and practical aspects of arbitration—both for drafting arbitration clauses\, as well as litigating in arbitration—to ensure their clients’ interests are protected. Course number 8600 is approved for 1 CLE\, all of which may be applied toward Ethics.
