The Health Law Section (“HLS”) website was recently updated with March through April 2019 articles that primarily focused on Florida and Federal legislative and regulatory updates. In light of the conclusion of the 2019 Florida legislative session, the Editors thought HLS Members would benefit from obtaining an update as to a significant bill that was being considered in the legislature. 3270 Be Careful What You Type: A Discussion on Professionalism

Emails and texts have replaced letters and telephone calls as an attorney’s primary means of communication with clients and opposing counsel. While they are convenient, they have a tendency to lead to unprofessional conduct. Attorneys may fire off an email or text without pausing to reflect on what they just typed. This CLE will review the Florida Bar’s position on professionalism as it relates to electronic communications, discuss some cases where attorneys were disciplined for inappropriate electronic communications to clients or opposing counsel, and offer some advice on how attorneys can avoid violating the rules of professional responsibility in their electronic communications.

Master Class on Mental Health and Substance Abuse Law
Begun as the “FUNdamentals of Health Law” series by James “Chet” Barclay in 2009, the 11th installment of the series does a “deep dive” into the legal, ethical, and technological issues arising in legal matters involving behavioral health and substance abuse treatment.
The program is designed to be immediately useful to attorneys, health care professionals, risk managers, and other health care industry participants needing to understand more thoroughly the issues and problems created by the opioid crisis, involuntary commitment of mental health patients, changes in federal law concerning alcohol and drug treatment, the increasing shortage of mental health professionals and the use of telehealth, and other critical issues. Morning and afternoon sessions will be followed by interactive panel discussions among faculty and both on-site and Internet attendees. Comprehensive materials will be provided.
